Professional Expertise
Health Law: Tina provides strategic advice to health organisations and individual practitioners on a broad range of medico-legal issues including: complaints from health and disability consumers; enquiries, investigations and proposals to name by the Health and Disability Commissioner; in-house reviews following complaints and adverse events; the regulatory and disciplinary processes established under the Health Practitioners Competence Assurance Act; policies on informed consent, open disclosure and sharing risk information; the Health Information Privacy Code, the Privacy Act and the Official Information Act. Employment Law: Tina advises employers, employees and unions on the full range of employment law issues; including discipline and dismissal; restructures and redundancies; employment agreements and policies and statutory compliance. She specialises in advising health organisations on balancing their obligations as a healthcare provider and an employer.

Background
Tina joined McBride Davenport James as a Senior Associate in January 2010. She has been in legal practice since 1995, having previously worked for two large national law firms in civil litigation and employment law, and for nine years in the public sector. Tina was a senior member of the in-house legal team for the Health and Disability Commissioner from 2002 to 2008. She provided the Commissioner with advice on a wide range of complaints and health policies, and has considerable first-hand experience with the Commissioner’s assessment, investigation and naming processes. Tina was also employed by the Ministry of Health to administer the Health Practitioners Competence Assurance Act 2003.
